ELIGIBILITY: The FLW Tour Chevy Open Can-Am ATV Giveaway (the "Promotion") is organized in the United States, is subject to the laws of the United States and will be governed and interpreted under the laws of the State of Minnesota, United States. NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. Offered only in the 50 United States and District of Columbia ("U.S.") and open only to legal U.S. residents who are 18 years of age or older. Employees, agents, successors, and assignees of Operation Bass, Inc., FLW Outdoors (the "Sponsor"), FLW Outdoors sponsors, Versus, U.S. Radio Stations, their respective subsidiaries, affiliates, advertising and promotion agencies, and members of their immediate families (spouses and parents, siblings, children, and their spouses and in-laws) and persons living in the same household of such employees are not eligible. Professional competitors in the FLW Tour Chevy Open event on Lake Ouchita from May 26-29, 2010, and members of their immediate families (spouses and parents, siblings, children, and their spouses and in-laws) are not eligible. Void where prohibited.
TO ENTER: Entrants must fill out an official entry form (“Form”). Only official entry forms provided by FLW Outdoors are accepted. No facsimiles are accepted. Limit one entry per person. One entry form per person will be available at the main entrance to the FLW Tour Family Fun Zone & Outdoor Expo on Lake Ouchita located in the Hot Springs Convention Center located at 134 Convention Blvd, Hot Springs, AR. Filled out forms must then be deposited at the Can-Am ATV Giveaway tumbler prior to 4 p.m. CT on May 29, 2010. No entries will be accepted after 4 p.m. CT on May 29, 2010. In the event the Family Fun Zone & Outdoor Expo is postponed and rescheduled, entries for the Can-Am ATV Giveaway will be null and void. If, for any reason, the Family Fun Zone & Outdoor Expo is cancelled and not rescheduled the prize will be void and eliminated from this Promotion.
DETERMINATION OF WINNER AND PRIZE:
MUST BE PRESENT TO WIN. An Outlander 500XT Camo Can-Am ATV (Approximate Retail Value $9,699) will be awarded to the Entrant who is present and whose name is drawn in a random drawing following the May 29, 2010 4 p.m. CT weigh-in taking place at the Hot Springs Convention Center located at 134 Convention Blvd, Hot Springs, AR. Odds of winning will be determined by the number of eligible entries received and number of entrants present at the time of the drawing.
In the event that the Entrant’s name that is drawn is not present another Entrant’s name will be drawn. This process will continue until a winner is present or 20 names are drawn. If no winner is present after 20 names are drawn at random, the ATV will be donated to a local charity.
GENERAL: All taxes on prizes and expenses related to the acceptance and use of a prize are the sole responsibility of the winners. By participating, entrants agree [a] to these rules and decisions of the Sponsor, judges and Tournament officials which shall be final in all respects relating to this promotion and [b] to release Sponsor and judges and their employees, officers, directors and affiliates from any liability, injuries, losses or damages of any kind resulting from their participation in the promotion or their acceptance, use or misuse of a prize including liability for personal injury or death. Return of any prize/prize notification as undeliverable may result in disqualification of winner and selection of an alternate winner. Winner agrees to use of name and/or photograph for advertising, publicity and promotional purposes without compensation (unless prohibited by law) and agree to execute specific consent to such use if asked to do so. By entering, participants grant the Sponsor the right to publish his/her name, hometown and photograph. Sponsor and its respective officers, directors, affiliates, employees, subsidiaries or agencies are not responsible and shall not be liable for: [a] any telephone, electronic, hardware or software program, network, Internet or computer malfunctions, failures, or difficulties of any kind, including without limitation, server malfunction or by any human error which may occur in the processing of entries; [b] failed, incomplete, garbled or delayed computer transmissions; or [c] any condition caused by events that may cause the promotion to be disrupted or corrupted. Sponsor reserves the right in its sole discretion to cancel or suspend the promotion or any portion of it should viruses, bugs or other causes corrupt the administration, security or proper play of the promotion, in which case, all prizes will be awarded via a random drawing from among all eligible entries legitimately received prior to cancellation. Entry information becomes property of Sponsor. No prize transfer or cash redemption permitted. No prize substitution except by Sponsor due to unavailability of a prize in which case a prize of comparable or greater value will be awarded. Limit one prize per household.
